1. Acceptance
By creating an account, signing in, or using any part of WineTracking (the "Service"), you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the Service.
2. The service
WineTracking helps you organize and value your wine collection: track bottles, manage cabinet storage, scan labels, run group tastings, and ask AI-powered questions about your data. We may add, change, or remove features at any time.
3. Eligibility and age
You must be at least the legal drinking age in your jurisdiction to use the Service. By using the Service you confirm that you meet this requirement. We do not sell, ship, or distribute alcohol.
4. Your account
You are responsible for keeping your account credentials secure and for all activity under your account. Provide accurate information and keep it current. One human per account.
5. Acceptable use
You agree not to:
- Use the Service for any illegal purpose or in violation of any law.
- Upload content you don't have the right to share, including infringing photos, labels, or attachments.
- Attempt to access another user's account or data, scrape the Service, or interfere with its operation.
- Use Ask AI or any other feature to generate content that harasses, defrauds, or harms others.
- Resell or redistribute the Service without our written permission.
6. Your content
You own your wine inventory data, photos, notes, and tasting records ("Your Content"). You grant us a limited license to host and process Your Content solely to provide the Service. We don't use Your Content to train AI models. We don't share Your Content with other users except where you explicitly enable a sharing feature (e.g., group tastings, shared cabinet links).
7. Subscription and payments
Pro tier is offered at $5.99 per month or $50 per year. Club tier is offered at $7.99 per month or $85 per year. Both billed via Stripe and auto-renew at the end of the billing period unless cancelled. You may cancel at any time from your profile; access continues through the end of the current billing period, after which your account moves to read-only mode until renewal. Refunds are available within 14 days of any payment by emailing support@winetracking.io.
Existing users prior to the public-tier launch are grandfathered to Pro indefinitely at no charge.
8. AI features and disclaimers
Ask AI, label scanning, drink-window estimates, and similar features rely on third-party AI models and statistical inference. They are informational tools, not professional advice. You are responsible for your own decisions about what wines to buy, drink, or store. We do not guarantee the accuracy of AI-generated answers, drink-window estimates, expert ratings, or market valuations.
9. Termination
You may delete your account at any time from your profile. We may suspend or terminate accounts that violate these Terms. On termination, we delete Your Content per our Privacy Policy.
10. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any data will be preserved indefinitely.
11. Limitation of liability
To the maximum extent permitted by law, WineTracking is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business opportunities. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the claim arose, or $50, whichever is greater.
12. Indemnification
You agree to indemnify and hold WineTracking harmless from claims arising out of your use of the Service, your content, or your violation of these Terms.
13. Governing law
These Terms are governed by the laws of the United States, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts in our principal place of business for any dispute that can't be resolved informally.
14. Changes
We may update these Terms from time to time. Material changes will be announced in the app and via email. Continued use after changes take effect constitutes acceptance.
